Terms of Service

These Terms govern your use of GymPlayer, including subscriptions, imported media, Tether sessions, exports, and your responsibility for the legality of the content you use through the app.

Section 1

Acceptance, Who We Are, and Eligibility

These Terms of Service ("Terms") govern your access to and use of GymPlayer and related support, subscription, and feature functionality.

By downloading, installing, accessing, or using GymPlayer, you agree to these Terms. If you do not agree, do not use the app.

GymPlayer is provided by Kobi Morris ("we", "us", "our"). Support contact: GymPlayerSupport@gmail.com.

You may use GymPlayer only if you are legally able to enter into these Terms. If you are under the age required to form a binding contract in your location, you may use GymPlayer only with the involvement and consent of a parent or legal guardian.

If GymPlayer is distributed through Apple's App Store, your licence to the app is also subject to Apple's Licensed Application End User License Agreement unless a different custom EULA is lawfully provided.

Section 2

Licence and Permitted Use

Subject to these Terms and any applicable Apple terms, we grant you a limited, personal, non-exclusive, revocable, non-transferable licence to use GymPlayer for your own lawful use on devices you are entitled to use.

You must use GymPlayer only in compliance with applicable law, these Terms, the rights of other people and businesses, and any Apple or third-party terms connected to the services you choose to use through the app.

Section 3

Subscriptions, Purchases, and Billing

GymPlayer may offer paid features through GymPlayer Pro or other in-app purchases.

The price, currency, billing period, free trial, and promotional terms shown at purchase time will control.
Payment is charged by Apple through your App Store account.
Auto-renewing subscriptions continue unless you cancel at least 24 hours before the end of the current billing period or as otherwise stated by Apple.
You can manage or cancel subscriptions through your Apple account settings.
You can use the in-app restore purchases function to request restoration of eligible purchases.
Billing, refunds, and payment disputes are handled by Apple subject to Apple's terms, policies, and applicable law.

Section 4

Your Content and Responsibilities

You are solely responsible for all content you import, store, edit, record, transfer, sync, export, display, share, or otherwise use through GymPlayer, including audio files, metadata, playlist names and descriptions, artwork, images, videos, recordings, exported files, and Tether session transfers.

You represent and warrant that you have all rights, licences, permissions, and consents needed to use that content in the way you use it through GymPlayer.

GymPlayer is not a cloud backup or content-hosting service operated by us. You remain responsible for backups, source legitimacy, and rights clearances.

Section 5

Prohibited Use

You must not use GymPlayer to:

import, upload, transfer, transmit, record, export, or otherwise use content unless you have the legal right and required permissions,
use illegal, infringing, pirated, stolen, fraudulent, deceptive, defamatory, abusive, harassing, hateful, obscene, or otherwise unlawful material,
violate another person's privacy, publicity, confidentiality, intellectual property, or other rights,
record, capture, share, or distribute another person's voice, likeness, performance, or personal information without any consent required by law,
send malware, harmful files, or material intended to interfere with a device, app, or network,
misuse Tether, nearby-device transfers, or export features for unauthorised distribution or unlawful sharing,
interfere with GymPlayer, its purchase flow, or third-party services used by the app,
bypass or tamper with subscription checks, purchase mechanisms, access restrictions, or app security features, or
reverse engineer, decompile, or disassemble the app except to the limited extent non-excludable law permits it.

Section 6

Tether, Recording Features, and Third-Party Services

GymPlayer includes nearby-device, media-sharing, and recording features. If you host or join a Tether session, record video, or export and share media, you are responsible for the legality of the content involved and for protecting your session code and deciding who you connect with.

Some GymPlayer features rely on third-party services or data sources, including Apple services and music metadata sources such as Apple iTunes Search, Deezer, and MusicBrainz. We do not control those services and do not guarantee continued availability, accuracy, completeness, or correctness of returned metadata or artwork.

Your use of third-party services may also be subject to the third party's own terms and privacy policy.

Section 7

Privacy, Suspension, Disclaimers, and Liability

Your use of GymPlayer is also subject to the Privacy Policy.

We may suspend, limit, or terminate access to GymPlayer features, support, subscription-linked functionality, or future updates if you breach these Terms, create legal or abuse risk, if Apple or applicable law requires it, or if we discontinue a feature or service.

To the maximum extent permitted by law, GymPlayer is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, error-free performance, compatibility with every file or device, or perfect metadata matching, synchronisation, export, or nearby-device transfer results.

Nothing in these Terms excludes, restricts, or modifies any right that cannot lawfully be excluded or limited, including rights under the Australian Consumer Law where it applies.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary loss, and we are not responsible for the legality or ownership of user content, third-party services, deletion or corruption of local files, or billing and refund decisions made by Apple.

To the maximum extent permitted by law, you agree to indemnify and hold harmless Kobi Morris, any related entities, officers, employees, and contractors from claims, losses, liabilities, costs, and expenses arising out of or related to your content, your breach of these Terms, your unlawful use of GymPlayer, or your infringement of another person's rights.

Section 8

Changes, Governing Law, and Contact

We may update GymPlayer, add or remove features, or change these Terms from time to time. If material changes are made, they may be reflected through the app, release notes, or the published Terms page.

These Terms are governed by the laws of Victoria, Australia, unless applicable law requires otherwise. You submit to the non-exclusive jurisdiction of the courts of Victoria and any courts competent to hear appeals from them.
